1. The RubyLink Service: A Community Platform

Welcome to RubyLink! These Terms and Conditions ("Terms") govern your access to and use of the RubyLink mobile applications, websites, and services (collectively, the "Service") provided by Joblify LLC ("RubyLink," "we," "us," or "our").

Please read these Terms carefully. By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

RubyLink provides a platform to connect individuals within local communities. Our Service allows users to post, discover, and communicate about user-generated listings for local jobs, services, marketplace items, rental properties, and other community-based services as we may introduce from time to time ("User Content").

2. Eligibility and User Accounts

To use our Service, you must be at least 13 years old and a resident of the United States or Canada.

Account Creation

You are responsible for providing accurate and complete information when creating your account and for keeping your password confidential. You are solely responsible for all activity that occurs under your account.

Account Types

We offer two types of accounts:

• Personal Accounts: For individuals engaging in non-commercial activities.
• Business Accounts: For businesses, service providers, and professionals. Business accounts may have access to different features.

Verification

We may offer optional verification features or premium plans (e.g., "Verified Badge"), but we do not independently verify the identity, skills, or background of every user.

3. User Content and Conduct

You are solely responsible for the User Content you post on the Service. By posting User Content, you represent that you have all necessary rights to do so and that your content does not violate any third-party rights or applicable laws.

License to RubyLink

You retain ownership of your User Content. However, by posting it, you grant Joblify LLC a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and promoting the Service.

AI Enhancement Feature

If you use our AI Enhancement feature, you understand and agree that the text you provide will be sent to a third-party service provider (Google Gemini) for processing to generate an enhanced description. Do not include any sensitive personal information in the text you submit for enhancement.

Prohibited Content

You agree not to post any User Content that is illegal, fraudulent, defamatory, harassing, hateful, discriminatory, or infringes on our community guidelines.

Prohibited Conduct

You agree not to use the Service to spam, phish, collect data without consent, or engage in any activity that could harm the Service or its users.

4. Content Monitoring and Reporting

To maintain a safe and trusted community, we have implemented the following systems:

Automated Monitoring

We may use automated systems to screen User Content for potential violations of our policies.

User Reporting

You can report any User Content or user that you believe violates our Terms. We will review such reports and may take action in our sole discretion.

5. Subscriptions and Payments

Premium Plans

We offer optional paid subscription plans ("Gold," "Platinum Pro"). Features and limits for each plan are described within the app.

Billing

Payments are processed through third-party platforms (e.g., Apple App Store, Google Play Store, RevenueCat for web). By subscribing, you agree to the terms and conditions of the respective payment processor. RubyLink does not store your full payment card information.

Auto-Renewal

Your subscription will automatically renew at the end of each billing period (e.g., monthly) unless you cancel it. You must cancel your subscription through your Apple or Google account settings, or the relevant third-party portal, before the renewal date to avoid being charged for the next period.

No Refunds

Subscription payments are non-refundable.

6. Termination

You may delete your account at any time. Upon deletion, we will make commercially reasonable efforts to delete all your personal data and User Content from our systems.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.

7. Limitation of Liability

(A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;

(B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES;

(C) ANY CONTENT OBTAINED FROM THE SERVICE;

(D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT;

(E) ANY PHYSICAL HARM, PROPERTY DAMAGE, FINANCIAL LOSSES, OR CRIMINAL ACTIVITIES ARISING FROM YOUR USE OF THE SERVICE OR INTERACTIONS WITH OTHER USERS;

(F) ANY DISPUTES OR AGREEMENTS BETWEEN USERS;

(G) THE QUALITY, SAFETY, OR LEGALITY OF ANY GOODS, SERVICES, OR ACCOMMODATIONS OFFERED BY USERS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

8. Indemnity

You agree to indemnify and hold harmless Joblify LLC and its affiliates, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorneys' fees) arising from your use of and access to the Service, or your violation of any term of these Terms, or your violation of any third-party right, including without limitation any copyright, property, or privacy right, or any claim that your User Content caused damage to a third party.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without respect to its conflict of laws principles. You agree to submit to the personal jurisdiction of the federal and state courts located in Kingston, Pennsylvania for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights.

10. General Terms

These Terms constitute the entire agreement between you and Joblify LLC concerning the Service. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect.

11. Changes to Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" at the top. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
